TRiNiD GrafX TERMS AND CONDITIONS

1. SERVICE AGREEMENT
TRiNiD GrafX shall provide its Services to YOU [the Client] under the Terms of Services [Agreement]. The Agreement is intended to keep the integrity of both TRiNiD GrafX and the Client and to protect both parties from liability. This Agreement will be enforced to ensure the speed, power, performance, payment, and reliability of our services.

By completing the Order Form and any other documents or agreements additionally specified in this Agreement, the Agreement constitutes the whole act of convention between TRiNiD GrafX and the Client [YOU], thus being the most significant document of the established relationship. In case that a court of competent jurisdiction considers that any of the Agreement's provisions is invalid, unenforceable, or void, the remaining ones will completely reserve their validity.

Client's side of the Agreement could be presented by: an individual with personal demands, being over 18 years of age; a legal entity such as a corporation, a limited liability company etc. that is consistent with provincial law system. If a person represents the Client for some reason, he/she should be legally authorized to act in his/her name, thus accepting, executing and delivering the Agreement.

YOU understand and agree that the Service is provided "AS-IS" and that TRiNiD GrafX assumes no responsibility for Agreement breakage.
2. SERVICE GUARANTEES

TRiNiD GrafX will guarantee 99% service satisfaction. This, however, does not refer to problems arising from:

3. MONEY BACK GUARANTEE

In cases where TRiNiD Grafx fails to produce to finished product to the Client, the Client is eligible for a 100% Money Back Guarantee. An eligibility process will be carried to determine whether TRiNiD Grafx is at fault and how and when the money will be returned. If TRiNiD Grafx is proved to be NOT at fault, your return is not eligible to be returned unless a further plead process is brought to attention.
4. NO UNLAWFUL OR PROHIBITED USE

As a condition of your use and purchases of TRiNiD GrafX Services, you will not use TRiNiD GrafX Services for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not attempt to gain unauthorized access to any TRiNiD GrafX Services, other accounts, computer systems or networks connected to any TRiNiD GrafX Services, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through TRiNiD GrafX.

TRiNiD GrafX reserves the right at all times to disclose any information as TRiNiD GrafX deems necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in TRiNiD GrafX`s sole discretion. Meaning, the Client will be protected to a certain point and Client information can be given to federal authorities if necessary.
5. THIRD PARTY

The Client [YOU] may be sent to third parties for purposes of printing, duplicating etc. Once you have begun business with them, TRiNiD Grafx is no longer responsible and is not liable for their actions. You will also be notified if sent to a third party.
6. UNSUITABLE BEHAVIOUR

Any indecent, abusive or insulting treatment towards a TRiNiD GrafX employee will be considered inappropriate. Each Customer is anticipated to behave in a well-mannered way with TRiNiD GrafX employees regarding any requests for help through e-mail, phone e.t.c.. Each Customer should avoid applying any forms of written emotional outburst. Any attempts of uncontrolled behavior will be interpreted as a breach of this Agreement.
Other acts of treatment towards TRiNiD GrafX employees that will be considered as unacceptable include any verbal, oral, written or delivered by second party threats addressing TRiNiD GrafX or any of its employees, partners, equipment, and concerns. Any forms of such threats will be interpreted as a breach of this Agreement. TRiNiD GrafX reserves the right if any of the aforementioned rules are violated to terminate  any projects and if further communication is not possible due to continued bad mannered client behavior even to once and for all stop client’s without issuing a refund!
7. YOUR RESPONSIBILITIES

YOU [The Client] is responsible for communicating with TRiNiD Grafx to update us on changes, removal, etc to ensure that there are no errors or they are kept minimal.
8. FORCE MAJEURE CIRCUMSTANCES

TRiNiD GrafX will be not liable in case of failure or delay in doing its professional duties in consequence of circumstances beyond its control. Such circumstances could be provoked by acts of any governmental body, war, rebellion, sabotage, embargo, fire, flood, strike or other labor disturbance, interruption of or delay in transportation, unavailability of, interruption or delay in telecommunications or third party services (including DNS propagation), failure of third party software or hardware or inability to obtain raw materials, supplies or power used in or equipment needed for provisioning of the Services.

This agreement constitutes and represents the whole act of convention between the parties in regard to the agreement signed between them. It is not subject to any amendments, changes or modifications, or any other alterations with the exception of changes introduced through a written instrument that is signed by the parties to be charged.
9. COPYRIGHTS

Clients MUST show proof of copyrights and trademarks in any instance of a legal issue. If proof is not detained, you are committing a crime and can be severely punished to the full extent of the law if further action is taken. TRiNiD Grafx is NOT responsible for Clients misconduct and abuse of the law.
10. PAYMENT

TRiNiD Grafx ONLY accepts payment online through PayPal Inc. We require the client pay 30% of the final price beforehand to ensure we are paid for our services.

11. TERMINATION
You agree that TRiNiD GrafX, in its sole discretion, may terminate your use of the Service, and remove and discard any Content within the Service if you violate these terms.
If you do not abide by these Terms and Conditions, your work will not be accepted.
